Attorney General Dana Nessel Argues Marijuana Use Does Not Disqualify Someone From Unemployment Benefits

On Monday, Michigan Attorney General Dana Nessel filed an amicus brief with the Unemployment Insurance Appeals Commission that argues whether someone who was fired for using marijuana outside of work is disqualified from receiving unemployment benefits.

Nessel says someone who is fired for using marijuana outside of work is still eligible for unemployment benefits.

She points to legal recreation marijuana as a guarantee to unemployment benefits if marijuana use is the only reason someone is fired.

According to Nessel, “The people spoke loud and clear when they voted in 2018 to legalize marijuana once and for all. Nobody over 21 can be penalized or denied any right or privilege solely for legally using marijuana, and employers cannot control their employees’ private lives by calling the legal use of marijuana outside of work ‘misconduct’.”
