A federal court has rejected an appeal by the Trump Administration to divert funds from the military to use for the border wall.
In a two to one vote, a panel of appellate judges at the ninth district court found the appeal violated constitutional requirements for the executive branch.
The Trump administration had issued an emergency request for the funds.
Asking that the judges temporarily lift a ruling from lower court injunctions.
The White House says they will continue to challenge the ruling.
