Both Sides Claim Victory in Court of Appeals’ Decision on Traverse City’s Tall Buildings Lawsuit

All sides are claiming victory in Traverse City’s that went all the way to the Michigan Court of Appeals.

The Appeals Court panel of judges issued a split decision Thursday, siding some with the city and the developer, Innovo, but also siding with the group “Save our Downtown.”

That group is celebrating the ruling that the proposed project on Hall Street – as designed now – is over 60 feet tall and would require a public vote. But the judges also said the city’s guideline for measuring building height is not specified by the city charter – meaning other add-ons above the roofline don’t necessarily count as part of the building.

Innovo says they will lower their building design by more than two feet to come in under 60 feet at the roof top. And the city says they have not yet determined how the ruling will impact the tall building proposal that’s on the November ballot.
