Biden Administration To Protect Gay Or Transgender Americans Against Sex Discrimination In Healthcare

The Biden Administration says the federal government will now protect gay or transgender Americans against sex discrimination in healthcare.

The move is the latest step in President Biden’s efforts to advance the rights of those who are gay or transgender, reverses a policy from the Trump Administration that looked to narrow legal rights for those individuals in situations involving medical care.

The new protections come after the Trump Administration defined the word “sex” to refer to the gender assigned at birth, excluding those who are transgender from legal protections against sex discrimination.

Xavier Becerra, Secretary for the Department of Health and Human Services, said Monday that those who are LGBTQ should have the same access to health care as everyone else.

Following these new protections, the HHS Office for Civil Rights will once again investigate complaints of sex discrimination based on sexual orientation and gender identity.

According to the Williams Institute at the UCLA School of Law, more than 1.5 million Americans identify as transgender. Additionally, according to Gallup, 4.5% of America’s population identifies as lesbian, gay, bisexual or transgender.
