Court Rules Line 5 can be Overseen by Michigan Public Service Commission
In this update on the ongoing Line 5 dispute, a court ruled the Michigan Public Service Commission does have some authority over Enbridge’s Line 5 tunnel.
A state administrative law judge ruled the commission can evaluate the need for Line 5 and whether it would be designed, constructed and operated safely.
The judge also ruled that the commission shouldn’t examine broader issues such as how the pipeline contributes to climate change.
The commission would not decide the tunnels approval, but would be able to question tunnel design, route, and safety standards.
