Appeals Court Accuses Grand Traverse County Judge of ‘Extreme Bias’
The state appeals court is ordering the release of a woman who was sentenced to prison for tampering with an electronic device. The court accused the Grand Traverse County judge who sentenced her of “extreme bias.”
A judge sentenced her to 13 months in prison last December because he believed she would use drugs while pregnant.
Samantha Hughes gave birth to a boy on July 2.
She has a history of drug use, but insisted she hasn’t used drugs during any previous pregnancies.
The court ruled Grand Traverse County Judge Thomas Power discriminated against Hughes last December by sending her to prison because she was pregnant.
Judge Power says he has no regrets about his decision.
Power tells the Associated Press that possible harm to the baby was “very real.”
