Michigan Appeal Court Won’t Dismiss Case Involving Rudyard Boy Who Suffocated
The Michigan appeals court will not dismiss a case involving a two-year-old Upper Peninsula boy who suffocated.
Back in 2013 Ethan Lawrence died in his Rudyard home.
They found he had been swaddled and was laying on the couch.
His mother, Mary Plis, and Donald Nelson are charged with involuntary manslaughter.
A district court judge dismissed the case, but the decision was overturned by a Chippewa County judge.
The appeals court affirmed that ruling Wednesday.
Two judges say there is enough evidence to show Plis and Nelson were negligent.
The other judge said there was no evidence that the couple knew or should have known the boy would be at risk.
