Judge in Kalkaska Murder Trial Rules Mistrial

The jury in the Kalkaska County cold case trial could not make a decision on whether Jason Ryan is guilty of murder.

Ryan is on trial for murdering Geraldine Montgomery. She was found dead in the trunk of her car.

Police say she was also raped at her home in Kalkaska County in 1996.

Two years later Jamie Peterson was convicted. He was cleared earlier this year when new DNA linked Ryan to Montgomery’s death.

Brittany Wright has been in the courtroom for the trial that ended in a mistrial Thursday.

Before 5:00, the jury could not make a decision. The judged ruled a mistrial – which means Ryan will be retried.

The defenses did ask for Ryan’s bond to be reduced, but the judge denied the motion.

Brittany spoke to both families afterwards to hear how they felt about the decision.

Geraldine’s daughter Ellen Montgomery said, “very frustrated; it’s been a long year of hearings and expecting a trial, which was equaling frustrating.”

“His family is going to suffer, his children – another year without their dad and I agree with Paul I feel sorry for you now both families,” says Ryan’s mother Elizabeth

Ryan will remain in jail on a $2 million bond.

A status conference will most likely be scheduled next month.
