Robert Kinney says his former employer wrote an online post accusing him of running a kickback scheme after being fired from a law firm in 2004.
A lower Texas court has already ruled the remarks should stay there, because otherwise it would be a restraint of free speech.
In a separate case, a Virginia woman was sued by her contractor for posting a negative online review of the work done on her on her house.
