Federal Judge Sends Michigan Same-Sex Marriage Case To Trial

Posted: Updated:

Wednesday, Michigan's ban on gay marriage could have been lifted.

Nine years ago the state declared that marriage should be between a man and a woman.

A federal judge heard arguments in a lawsuit filed by two Detroit-area women.

They say the ban on same sex marriage violates the US Constitution's Equal Protection Clause.

Several Michigan counties says they will issue licenses if the judge overturned the amendment from 2004.

However, the judge did not issue a ruling Wednesday sending the case to trial.

County clerks across the state, including in Wexford County, had been preparing in case the ban was overturned today.

So far 13 states and the District of Columbia allow same-sex marriage.

The trial is scheduled for February 25th.
