Wexford County Prosecutor Candidate Files Lawsuit Against County and State

Candidate for Wexford County Prosecutor, Jason Elmore, has filed a lawsuit asking the court to order the county to do a recount.

Elmore petitioned a recount of votes from his race with Tony Badovinac.

That petition was denied by the Wexford County Board of Canvassers on Friday.

Elmore cites his legal right to a recount and the close margin between him and his opponent, only 6 votes.

Badovinac says Elmore is just trying to get a "third bite at the apple" because he is not satisfied with the voters decision.

Badovinac released a statement regarding the instituting of Jason Elmore's lawsuit against Wexford County and the State:

"Mr. Elmore is suing Wexford County and the State of Michigan, requesting a court to order the county to conduct a recount. By suing the county, Mr. Elmore is trying to get a proverbial "third bite at the apple." Mr. Elmore was not satisfied with the voters' decision, with the Board of Canvassers' decision, and now he is going to a third audience—a circuit court judge—to get what he wants. 

The Board of Canvassers made their decision on Friday to took no action on Mr. Elmore's petition. Unfortunately, because of Mr. Elmore's lawsuit, Wexford County is now going to have to expend taxpayer dollars on paying an outside law firm to litigate this lawsuit. 

I believe in the integrity and the accuracy of the voting process, of the Wexford County election officials, and the system they have put in place."
