Court Granting New Trial for Kalkaska County Man

A man convicted of manufacturing a controlled substance in Northern Michigan has already served his time, but he could be getting a new trial.

A state appellate court has granted a new trial for Archie Kiel in Kalkaska County.

Kiel was convicted by a jury back in 2010, he was sentenced to 5 months in jail.

Kiel believed he was abiding by the medical marijuana law by growing marijuana plants in his home, but the prosecutor says he was growing too many.

Although the state has granted a new trial, it still has to be approved by the Kalkaska County prosecutor.
