Michigan Supreme Court Drops Big-Box Store Tax Case

The Michigan Supreme Court has shot down an appeal over how big box stores are taxed.

The appeals court announced a 2016 decision will stand, ending the practice of the dark-store tax theory, a loophole in property tax law that allowed big box stores to value their properties at the same value as closed and abandoned big box stores.

The court also said the Michigan Tax Tribunal didn’t use the proper standard to determine the value of a Menards in Escanaba.

The Michigan Association of Counties says tax revenues have been reduced by about $100 million statewide since 2013.
